Article 3: Offers
Délia Bodi's offers are aimed at individuals aged at least 18 with full capacity to contract, domiciled and / or resident in mainland France and overseas (Guadeloupe, Guyane, Martinique, Réunion, Mayotte, Saint-Pierre-et- Miquelon) or in one of the following countries: Andorra, Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, French Polynesia, Germany, Greece, Hungary, Ireland, Italy, Japan, Latvia, Lithuania, Liechtenstein, Luxembourg, Malta, Monaco, Norway, Netherlands, New Caledonia, New Zealand, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, South Africa, South Korea, Spain, Sweden, Switzerland, United Arab Emirates, United Kingdom, United States
The validity of the offers is limited for the duration of the placing online of the products, and within the limit of available stocks. Délia Bodi is a website which is intended exclusively for the end customer, and does not authorize the purchase of a quantity greater than 4 equal pieces per article, size and color.
During the purchase validation process, it is possible to request a gift package at a cost of 4 euros. The gift will be sent to the delivery address without the indication of the prices of the articles, and can be accompanied by a greeting message which can be personalized.
The invoice for the order will be sent by email from the sender.
Article 4: Price
All orders made on the site www.deliabodi.com are payable when ordering. The prices are indicated and payable in Euros all taxes included, shipping costs included for metropolitan France.
For countries which do not adhere to the Euro, the exchange rate is set by the bank that issued the payment card used for the purchase.
Délia Bodi reserves the right to modify its prices at any time, but the items will be invoiced on the basis of the prices in force at the time the order is placed.
The amount of VAT is indicated when selecting a product by the customer. The prices take into account the VAT applicable on the day of the order and any change in the rate may be reflected in the price of the products in the online store.
For residents outside the European Union, the items are invoiced excluding VAT: when the order has been completed with the delivery address, the price of the order will automatically be displayed excluding VAT. The customer must pay directly on delivery the amount of taxes and Customs charges corresponding to his country.
Payment of the full price must be made when ordering.
Article 5: Payment
Payment of items ordered is done online:
- Credit card : CB-Visa/Mastercard - via the secure payment service CMC-CIC p@iementwith the3D Sécure system to authenticate the buyer when paying.
The flow rate of the card is performed immediately after confirmation of the order.
This payment system allows for secure transactions. Indeed, the customer's bank information (credit card number, expiration date ...) are transmitted directly to CMC-CIC p@yment, thanks to a system consisting of a 128-bit SSL encryption protocol which guarantees on line transaction security. It is for this reason that the company Bodi Delia does not know the details of the credit card of the buyer and therefore can not classify them or keep them.
The payment system delivers an electronic certificate that will be considered proof of the amount and the date of the transaction in accordance with the provisions of Articles 1316 and seq. of the Civil Code.
Article 6: Availability of articles and delivery
The order will be shipped at the latest within 3 working days (unless otherwise indicated on the item sheet) from the day following the day the customer has placed the order.
EIn case of unavailability of the ordered item, in particular because of our suppliers, the customer will be informed as soon as possible and will have the possibility of canceling his order. Délia Bodi undertakes to reimburse the customer within a maximum period of 14 days.
Delivery of the items will be made to the address indicated in mainland France during the ordering process, except in cases of force majeure, by La Poste in "Colissimo,delivered against signature".
At any time, thanks to the code number that we will communicate to the customer, he can track his package by connecting to the Colissimo site to find out where it is.
The customer is delivered to his home by his postman and signs a delivery slip acknowledging receipt. In the event of absence, the customer or the recipient of the ordered product receives a notice from his postman, which allows him to collect the ordered products, at the nearest post office, for a period of 15 days.
The customer is required to check, in the presence of the post office clerk or the delivery person, the condition of the packaging of the goods and their contents on delivery.
In the event that the customer has any doubt of any kind whatsoever on the condition or content of the package, he is required:
- to apply the Colissimo procedure (in particular to report the damage due, all complaints and reservations) and to refuse the goods by immediately issuing a report of anomaly to the post office employee (finding 170).
- to report these incidents to Sarl Délia Bodi.
However, if the delivery deadlines are exceeded, Délia Bodi cannot be held liable for any reason whatsoever.
In the event of an unclaimed package, incomplete or incorrect address, if it returns to the premises of Délia Bodi, the transport costs of the return will be borne by the customer.
The customer is required to check the conformity of the goods delivered at the time of delivery.
Any complaint, whatever its nature, relating to the products delivered, will only be accepted if it is made in writing, by registered letter with acknowledgment of receipt, within 72 hours.
For shipments abroad(outside mainland France) the amount of shipping costs, the shipping method, and the delivery times are given as an indication on the delivery page of the site www.deliabodi.com. They may be subject to change, depending in particular on the weight of the package. Any order validated on the site and delivered outside the European Union may be subject to any taxes and customs duties which are imposed when the package reaches destination. These customs duties and any taxes linked to the delivery of an article are the responsibility of the consumer and fall under their responsibility. Délia Bodi is not required to check and inform its consumers of customs duties and applicable taxes. To know them, it is up to the customer to inquire with the competent authorities of the country of destination. In the event of the recipient's refusal to pay customs duties or taxes, the sums possibly requested from the company Délia Bodi to recover the package will be deducted from the reimbursement made to the customer.
Article 7: Shop pick up
To be able to collect their parcel at the Délia Bodi store 3, rue Chauveau-Lagarde 75008 Paris, the customer must imperatively bring a valid identity document. Otherwise, the products ordered cannot be returned.
The customer has a period of 15 calendar days to collect his order from the store.
Article 8: Withdrawal period - Return procedure
The customer has a period of 14 days from receipt of the package to return,at its expense, any item that does not suit him. The cost of returning items returned following an error by the seller will be borne by the latter. This period runs from the day of delivery of the customer's order. If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day. Only items returned complete with their labels and which have not been soiled or damaged, and marketable again will be taken back.
For hygienic reasons, we cannot accept the return of stockings and tights or briefs or swimsuits which have been worn in direct contact with the skin. Délia Bodi reserves the right to refuse returns of products that do not comply with the said conditions.
The returned items will be, at the customer's choice: exchanged or refunded.
The reimbursement of the customer by the company Délia Bodi will take place within a maximum period of 14 days from the date on which the company became aware of the customer's withdrawal.

Article 9: Force majeure
The responsibility of the company Délia Bodi will not be engaged in case of force majeure and the contract may be terminated without any compensation being due. Among the cases of force majeure are listed in particular: blockage of means of transport, strike by suppliers or carriers, fire, storm, flooding, stoppage or serious and prolonged deficiency of telecommunications networks.
Article 11: Applicable law and competent jurisdictions
These General Conditions of Sale as well as the contractual relations between the customer and the company Délia Bodi are governed and interpreted in accordance with French law. Any dispute relating to the interpretation, execution or breach of contract concluded between the client and the company Délia Bodi, even in the event of multiple defendants, will be submitted to the competent courts.
